000778 Couple Files Suit vs. Burger Chain

Beaverton, OR - A Beaverton couple has filed a $7 million federal lawsuit against a popular hamburger chain, accusing some local employees of spiking their burger with hair, soap, staples and spit.

“I love Jack in the Box and it just didn't look right,” said one of the plaintiffs, 24-year-old Dustin Harrington.

After taking a bite of the burger earlier this year and seeing what was inside, “then I was like 'Oh, my God.' I couldn't believe it,” Harrington said.

He and Colleen Murphy also contend in their lawsuit that a Latino employee at the Jack in the Box restaurant in neighboring Hillsboro made a racist comment about Harrington.

A Jack in the Box spokesman said the company is investigating. He said employees at the Hillsboro location have been interviewed and the burger was tested.

But he would not reveal what the San Diego-based company has learned.

“From the time of the allegation, we've been doing a thorough investigation,” said spokesman Brian Luscomb.

“I can say Jack In The Box has the most complete food safety system in the industry. The USDA refers to our system as the model for the industry.”
